Standards, Rules and Regulations for the Construction Industry as per the provisions of CID Act

Construction Industry Development Act No 33 of 2014 (CID Act) was established with the view to regulate, register formalize and standardize the construction industry and thereby, provide for the development of the construction industry in Sri Lanka.

The Section 18 of CID Act provides to formulate Standards, Rules and Regulations in the construction industry by appointing committees in consultation with relevant authorities, professional bodies and other social and environmental organizations.

As per the Section 12 of CID Act, it is one of the objects of CIDA to formulate in consultation with other relevant authorities, the standards in the construction industry and categorize such standards as compulsory and voluntary standards.

Another object of CIDA under Section 12 is to implement the codes of conduct, practices, procedures and processes and documentations relating to construction industry as being formulated by CIDA.

CID Act empowers CIDA to formulate Rules and Regulations to be published in the gazette. As per the Section 57 of CID Act, CIDA may make Rules in respect of all matters for which Rules are required or authorized to be made under CID Act.

As per the Section 58 of CID Act, the Minister in charge of the subject of construction may make regulations in respect of any matter required by CID Act to be prescribed or in respect of any matter which regulations are required or authorized by the CID Act to be made.

There are 17 Regulations and 09 Rules (altogether 26 Rules and Regulations) to be published under the provisions of CID Act. These Rules and Regulations are published, strengthening the provisions of CID Act ie: to regulate, register, formalize and standardize the stakeholders and activities of the construction industry.

The Rules and Regulations under the CID Act are relating to the registration of construction industry stakeholders, ie: local and foreign Construction Contractors, local and foreign Consultants (Qualified Persons), Property Developers, Adjudicators, Quality Management Auditors, Importers, Manufacturers and Suppliers of Construction Materials and Components, Skilled Construction Workers, Construction Site Supervisors, Middle Level Technical Officers and other professionals in the construction industry. and also on the processes of such as Monitoring Mechanism of Construction Contractors, Issuance of Crafts Identity Cards for Registered Skilled Craftsmen, Procedure of Adjudication, Technical Auditing, Disciplinary Procedure for Contractors and Consultants, Appellate Procedure against decisions of CIDA by formulating of the Appeals Board, formulating of the National Data Base of the construction industry and its Information Secretariat and Collection of Data & Information for the National Data Base.

 

Therefore, by implementing the above Standards, Rules and Regulations under the provisions of the CID Act, CIDA shall be above to achieve the purpose of the CID Act ie: to regulate, register formalize and standardize the construction industry and thereby, provide for the development of the construction industry in Sri Lanka.
